
Bad Corporate Actors Should Have No Right To Do Business
From destroying land, water and human health through mountaintop removal coal mining to allowing the deaths of 29 coal miners in the biggest coal mining disaster in the U.S in over 40 years, Massey Energy has shown little regard for Appalachian communities and people.
A scathing report commissioned by then West Virginia Governor Joe Manchin points the finger squarely at Massey Energy for the deaths of 29 miners from a massive explosion at the Upper Big Branch mine in Montcoal, West Virginia in April 2010. The report indicates that lax safety standards and a culture of greed rampant throughout the company created a chain of events that caused the disaster.
Massey must be held responsible for its lethal recklessness. Even after merging with Alpha Resources, Massey Energy still exists as a wholly-owned subsidiary. Therefore, their corporate charter still exists- and they need to be held accountable. They can merge, but they can’t hide.
Companies like Massey can do business only because “we the people” grant them a corporate charter. Since Massey Energy is legally based in Delaware, state Attorney General Beau Biden has the power to revoke Massey’s right to do business.

The latest: We have renewed our call to the Delaware Attorney General to investigate revoking Massey Energy’s charter after the company was made to pay over 200 million dollars in criminal penalties, civil penalties, and compensation to the families of the 29 miners who were killed. However, the settlement absolves Alpha Resources’ corporate criminal liability. This is simply not right.
